j4 commentary addendum continued...

As Senatorial members of Congress resume general comments for and against the nomination for the Supreme Court Judge Sonia Maria Sotomayor of the U.S. Court of Appeals 2nd Circuit, Committee Senators review the resumé of the Waxman/Markey "Climate Change and Energy Bill". 

And so the story goes...

If you walk into a court of law and ask the judge if he or she carries and oath of office and if said judge brought that oath in the courtroom with them, they will immediately calculate an objective view that you're in contempt.  So why would any judge be compelled to dispense such a deluge of injustice throughout their entire well being? The oath of office administers that nothing except any and all precisionism (precise & sharply defined opinion geometrical in formation) be blind upon the scales of justice no matter the weight of argument even if opening remarks have standing that such judge shall not, but will adhere every exact mannerism bound by law. And in a manner of speaking, it plain and simply questions the merit of their authority that binds them to stand trial themselves upon the grounds of competency; relevant and/or irrelevant. However, it's neither ear nor dare and social suicide exacts such outcome whereas meritorious definition of the framers intent pertains to foundation in any days' real moral fiber. 

And goes the story so... 

As a principle of justice; impartiality holds that decisions should be based on objective criteria rather than on the basis of bias, prejudice, and/or preferring the benefit of one person over another for improper reasons. So why the debate of Republicans to discredit the soon or not soon to be Justice Sotomayor as to her objective interpretation of the Constitution? Obviously that has implications as to the credibility of those Senators attempting to depose the nominee on the merits whereas experience and rational shall condemn itself as the will of the individual justice to interpret and determine the meaning of the Constitution jurisdictionally within their own separation of power on the bench.  
 
And the story goes so...
 
To resume in general terms is to take or assume use or practice of again.  So assuming that resumé is the summing up of written accounts of personal, educational, and professional qualifications & experience of an applicant for a job, there seems to be some discrepancy translation lost in the make an as out of me and you get the u dangling participle.

In the realm of debate, the President schedules a schedule of events; the Congress schedules a schedule of meetings & hearings; the Supreme Court schedules a schedule of oral-formulaic strategy based on precedence; the CEO of any company schedules a schedule of investment reallocations for staying in business; and all the way down to the volunteer crossing guard schedules a schedule of stop and go for cars and children to all get to their destinations safely.

Last words in the lane:
 
Being not partial or biased but fair and just is not the question of the Waxman/Markey Climate Change and Energy Bill, it is the answer of language that can be ratified by underlines and strikes whereas the people of the United States have just one thing in common.  Foreign or domestic; no-one comes into "our" house and pushes "us" into the ground and gets away with it!

A 4th of July commentary prelude...

All of our members of Congress are distinct representatives of their district in the House and a one half representative of the whole State in the Senate.  And although all members go to Washington to carry constituent voices for what specifically concerns their own the most, the biggest obstacle is just this one thought: 
 
"As members of Congress, those individuals represent The United States as a whole and choices they make independently for the betterment of their own district and State forget just how free this Country really is. Citizens travel to every other district and State across the Nation and in awe & wonderment of specialties they don't have, most agree on this one single thought.  "How can we keep our own hometown identity and however bring what is described as lackluster deficiency into view of validating standing for us and them without being granted the detriment of wasted effort".   
 
Not to be separated, given, or taken away is our guaranteed "unalienable" right which brings us exactly in line with why the beginning of The Declaration of Independence states We Creator Rights are Life, Liberty, Happiness. The simple translation is that it's not always our own devise when things don't work in, out or the other and it really isn't because local, state, and federal government are the ones making all the rules. However, the hard truth is that these days an overwhelming population causes it to be explained as written. So what is an exit strategy that doesn't enter into just another argument of wasted time?

With jobs lost, gained, and on the sidelines, all business America stabilizing and expanding across the Nation are searching for legitimizing necessary rigors when decisions in Congress cut off routes of venture via their usual anti-unfettered representation. The interpretation is that re-routes mostly amount to nothing in the support department except an unwelcome mat at the front door and an enter at own risk at the back unless you can swim your way through a mountain of red tape or a team of lawyers.  And although these abridgments are building better bridges, Americans are looking for the freeway where their output actually returns inputs where they aren't further burdened when they thought they already covered issues of unifying responsibility.  
 
We elect representatives on the notion that they will make our life easier, and not look us in the eye and say it isn't so when they don't. Even further disappointing is that when all the chips are down, politicians usually don't get our overall best interests accomplished and although we know they keep us in mind mostly trying to follow through with their hearts, that attempt of redemption is just not simply within the boundaries of 21st century comprehension. So how does this subsidiary point get flushed out in an amicus curiae side bar brief?  

Adversary participation is the best part of growth and keeping the life-liberty-happiness part of a full life is just keeping a sense of humor when you fail.  It's a proven theory of acceptance any way you look at it and you can see it exists in Congress even if 80 percent of the time they represent the Hatfield & McCoys ready to rip each others hair out while in opposition floor debate.  So when does veto recognition become it's own impediment of American progress exasperated from common ground unanimity?  The exact description is that Democrats are the left, Republicans are the right and Independents are centered around holding the full weight in balance truly concerned with taxes, fines and penalties in the verbatim department.

What's fair is where everyone knows it's necessary for deductions to support the overall infrastructure of our Country's well being that stretchesthoroughly through local, state, and federal that's also re-distributed evenly back to those putting in. So what is exactly fair?I'm not sure but it would take about 24 straight hours to add up all the different things we get overtly taxed for that spells out double, triple and quadruple jeopardy and for that there is only one thing that follows the Declaration of Independence we can all agree that quite simply begins "We the People of the United States, in Order to form a more perfect Union..."

This one goes out for people who keep working on the "fairtax plan" even when the chips are down and it may look like the little people are getting all the breaks at the helm of those who have both hands to give.  However, think about it.  We only have time for ourselves most of the time and although it is a true strength, the weakness obviously reveals itself as our distraught nature that always keep us complaining about government exactly due the taxes, fines, and penalties thing that gets ripped out of our person place. And at the heart of it all, it's the mind over that matters where I'm sure we can all agree.

Obama loses sight of green bridge thru foggy haze...

In the sink or swim shipping lane, President Obama missed the boat with today's announcing efforts to give the bi-partisan Congress a leadership of confidence push on the Energy Bill.

Key points of overtime pay in a 40 hour work week were in the Bernanke Hearing that the FED Chairman "had no regrets for the massive project that was dumped in his lap last year" for keeping America's power players afloat.

In reality Bernanke took a dilemma that looked like a definite stop sign, stood each issue upright on 1 of it's 8 corners one after the other and kept calm while diverting the perfect storm.

Strains and stresses are still fragile, however, what's evidently transpiring is that now when Bernanke goes to the Nations' safe and opens the combination, the hinges don't creak in hallowed halls of collapsed empty buildings.

The simple translation is that President Obama didn't offset the right vote of confidence to reverse probable jobs loss columns in the Energy Bill such as current support for fossil fuel expansions where Exxon Mobile is investing 100 million dollars for a carbon capture system-including the need for pipeline support in Alaska-for the Natural Gas division.

Some win and some lose.  It's our natural adapted concept of gravity of what goes up comes down.  So as un-employment heads out on the highway on-ramp instead of getting diverted in the re-routing compromise President Obama asked of Congress for creating, keeping, initiating and promoting jobs, the un-employed may not even be able to get a ride because the loss of payroll, medicare, and social security taxes will En Block half finished infrastructure bridge repairs due to major cuts everywhere for The Great Health Care Compromise.

Even if the un-employed get lucky and secure a job at a carbon capture coal facility, there's only one in Alabama here in the United States and at 1 Billion Dollars per facility, those investors need all the help they can get so they can also invest in ways to make coal mining a safer process. 

Our natural resources and the uses for them don't go away, and the only question to that answer brings us full circle of either finding liquid solutions for cap and trade program or the whole deal will need another round of Bernanke interference.  And although this Country still needs Ben to wade through murky waters, it would be a lot better if dollars for big banking were used from their own enterprising entrepreneurship abilities in the all around loans process that has fail safes built in before the actual default system proclaims success. 

Since we're on the subject of natural resources and mining, there's a "middle ground non-ferrous mining issue" in Minnesota where there's plenty of ore to go around also where the lakes are used for recreation. Since the honeymoon is obviously over with the Obama Administration, maybe Chief of Staff Rahm Emanuel can quit re-enacting the Bush Administration up in spending and down in progress to figure out an environmentally friendly time table where issues such as the Minnesota non-ferrous mining issue can route it's usefulness & clean up around recreation months where Americans are surely needing a break from dilemmas of nil-representation when it comes to the people's overall will.  

Last words in the lane:

Americans would start living up to better standards if strategic, tactical, and operational management would finite less micromanagement ways of travel from the President & Congress who at least take a few moments to discuss the real option of any rule's original rationale. What-why?  The everyday American potential for data-flow diagrams that create, keep, initiate and promote jobs in the art of business resumption planning. Where-when?  A model of objects, associations, and activities of how our American ways can all travel around each other through the deciphered process of anticipation that provides relief before disasters entangle the one single common denominator of spend, spend, spend more government spending.

Koh brings out right Republican base...

In the absence of quorum, a few members of Congress in the Senate debated the 30 hour rule ensuing the "sovereignty stratagem" of Harold Koh for nomination as State Department Legal advisor. 
 
In worthy attempts to circumvent this nomination, discussions of the Koh ideology were geared around his views that United States policy should conform and adhere to an international rule of law instead of the sovereignty Americans consistently fight, live & die for keeping the international stage from taking away our citizens' rights in due diligence of keeping law makers and enforcers from enacting a clandestine empirical tyranny. And right now in history, what our Country went through is well informed through the media via Iranian policy that's the brutal characterization of observation without using scientific method of theory executed with the secrecy of concealment instead of allowing freedoms to regard peaceful demonstration as the platform for voicing what detriment(s) faces them most.

As the most popular vote of the people, the "sovereignty stratagem" is not a plan, scheme, or trick in surprising deceit of the people from this Country, it's a guaranteed right of our freedoms strictly grounded in our Declaration of Independence.  Not only is this most popular, but it's most favorable whereas keeping government out of peoples' personal lives except where tax allocations are concerned as well as protections of our collective embodiment as the States United also guaranteed in the separate but equal clause.
 
Not to say our Constitution is perfect certainly implying not imperfect, there are many facets of our society that have become comfortably numb and when it comes to our legal system, the three friends and a stranger "sovereignty stratagem" is one of the worst purely translated as "the status, dominion, power, or authority who use any artifice, ruse, or trick devised to attain a goal for gaining an advantage over another".  Even more within this interpretation, the 3/1 ratio stratagem references that courts are so overloaded that an almost mandated common practice is that the prosecutor and defense attorney will overtly plea bargain the entire case load whereas the judge will hand down the fiercest of penalties if the defendant loses in a criminal trial. Civil law also has this unbalanced perception, however the good thing about our system is that there is an appellate system whereas international policy is moreover based on premise of the "you're cooked on all sides" reactionary measure to contain actions of any person, place or thing that goes against the grain.  The overall good thing about our system?  It's why we've come so far in such a little time, and why other nations look to us for leadership instead of us of them.

The gotcha good faith example of the "sovereignty stratagem" is how Democrats maneuvered union votes and monetary support for returns whereas auto worker union leadership gained ownership of vehicle manufacture infrastructure over shareholders.  On it's face it looks like big government invoked it's overwhelming force to bully investors out of their rights.  However sad but true, the real lesson learned is that legislation re-write support actually undermined an immoral socially accepted system in an end to a means where shareholders disregard the livelihood of workers as easy as slicing butter with a hot knife.  With regards to morality? The simple translation is that emphasis is placed squarely in view that the worker is the important factor instead of a race horse put out to pasture before it's time without the benefits they put forth extra effort everyday to achieve.  Nothing more and nothing less except of course for scandalous union leaders that manipulate the process while claiming to protect workers rights.

The sense of imperfection is that there are flaws with every system and this Country has the satisfaction of challenge in correcting discrepancies where an overall international policy will not. In view of that, the problem with the political genius of the General Motors/Chrysler deal is that valuable franchise ownerships were caught up in the cross fire as victims of the 3/1 ratio stratagem and if we as a Country are to overcome in leaps and bounds without opening the flood gates of an already overwhelmed judicial process, all political savvy should be reminded that our National heritage of immigrants came here to get away from all tyrannical cycles that observe the "spoils system" as the accepted social Czar network it really is.

In view of Harold Koh and other great white shark attorneys in need of being deposed by "The Orca", sometimes lyrics in music move moments like the navigant un-sung hero in the periodic table of elements reminiscent of "sometimes the darkest hour never comes at night", and the cross reference shepard's citation is that the un-sung hero in the periodic table is the American Element (Hu1) reviewing previous laughter that echoed all the way to the bank in favor of the shinedown take your medicine ideology. Nothing more and nothing less pursuant to the perfection of colloquy of course excluding extraneous materials.
